These terms cover the website at zvisualz.com. A shoot we do for you is governed by its own written agreement, and where the two differ, the agreement wins.
Agreement
By using this site you agree to these terms and to our privacy policy. If you do not agree, please do not use the site. "We", "us" and "our" mean Elite Cratif LLC, a California limited liability company doing business as Z Visualz.
What the site is for
The site describes our production services, shows examples of our work and lets you ask about a shoot. Nothing on it is an offer that binds us until we have both signed a written agreement.
Not professional advice
Articles and production notes on this site are general information drawn from our own work. They are not marketing, legal, financial or medical advice for your situation. Each production is credited for what we actually did, whether we shot and cut it or edited footage someone else filmed.
Your use of the site
You may view pages for your own reference. You may not copy the site or its content for commercial use, scrape it in bulk, download the footage, attempt to interfere with the site's operation, submit forms with false information, or use it in any way that is unlawful. Sending the booking form does not create a client relationship.
Intellectual property
The text, design, photography, video and code on this site belong to us or to the clients and licensors who allowed us to show them. Client names, logos, products and the people who appear in client footage belong to, or are shown with the permission of, those clients. Nothing here grants you a license to any of it beyond viewing the site.
Links to other sites
We link to client websites, to Elite Créatif and to other third-party sites. We do not control those sites and are not responsible for their content or their privacy practices.
Disclaimer
The site is provided as is. To the fullest extent permitted by law we disclaim all warranties, express or implied, including that the site will be uninterrupted, error-free or free of harmful components, and any implied warranties of merchantability, fitness for a particular purpose or non-infringement.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred US dollars. Some jurisdictions do not allow these limits, so they may not apply to you in full.
Indemnity
You agree to indemnify us against claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these terms or your misuse of the site.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
Changes
We may update these terms. The effective date at the top of the page tells you when they last changed. Continuing to use the site after a change means you accept the new terms.
